APPENDIX ONE – TERMS OF REFERENCE & LIST OF RELEVANT NGO NETWORKS

1. Project Title:        NGO Observations on the First Year of Implementation of the RGCfs Governance Action Plan 

2.      Project Location:  Phnom Penh

3.      Project Consultants:

The gTeam Leaderh shall be directly responsible to the Representative of the NGO Forum on Cambodia for attainment of the project objective within the allotted time frame.  The Team Leader shall also supervise the work of the team member. 

The gTeam Memberh shall report directly to the Team Leader, while under the overall supervision of the Representative of the NGO Forum.  The Team Member shall be responsible for the achievement of all tasks given by the Team Leader in order to contribute to the success of the project. 

Background:  Government, donors and NGOs all agree that good governance is a necessary prerequisite to sustainable socio-economic development and social justice.  In February 2001, the Council of Ministers approved a Governance Action Plan (GAP) covering the sectors of legal/judicial reform, administrative reform, anti-corruption, decentralisation, fiscal reform, armed forces reform & demobilisation, gender equity, and natural resources management.  The GAP contains benchmarks for monitoring and planned actions for completion in the short-term (1 year) and long-term (2-3 years).  The Secretariat of the Council for Administrative reform has formal responsibility for monitoring all sections of the GAP.

Objective: 

Produce an reasonably accurate and diplomatically worded document which presents the observations and ideas of NGOs in Cambodia on the progress of the governmentfs Governance Action Plan.  The intention is to provide constructive comments on how NGOs, donors and government can further contribute to the success of the Plan.

Activities:

Activities required in the production of the report include: 

  1. Background reading, meet with experts, NGOs, donors and government, and produce a draft report. 
  2. Meet with sectoral groups of NGOs and with the Civil Society Forum to gather further input on NGO perceptions of the reform and to gather feedback on the draft. (see list of possible NGO contacts in the Appendix of this TOR).
  3. Visit one or two provinces to verify some information with provincially-based NGOs.
  4. Meet with the Civil Society Forum and other relevant sectoral groups to discuss findings to date.
  5. Regular (at least weekly) meetings with the Representative to report on progress and discuss plans.

All meetings with NGOs are also intended to consolidate NGO understanding of and ownership of the report.  A list of possible NGOs and NGO sectoral groups that could be consulted is listed in the Appendix. 

Note that the report will be shared with government for their comment before being made public.  The report will contain an Executive Summary, chapters on each sector (as mentioned above under Background), a list of references and a list of people interviewed.  The chapters on each sector should contain the following sections:

  1. Introduction
  2. Summary of NGO involvement in the sector
  3. Summary of progress in achieving short-term and medium-term objectives
  4. NGO perceptions about the current state of progress
  5. Suggestions on how NGOs, donors and government can further contribute to the success of the Plan.

Tentative Timeline:

11-20 February:  Reading, interviews with experts on reform to understand current status of the reforms – produce GAP status report which will form part of the final report.

21-1 March:       Meeting with NGOs to gather their ideas

3-8 March:         Visit a province

11-15 March:      Meetings with NGO sectoral groups, Civil Society Forum – produce draft report.

18-23 March:      Finalise report
